Terms of Service

OSHA Scan is a product of GetAgenticApps LLC ("GetAgenticApps", "we", "us", or "our"), a company that builds AI-powered software for business operations. By creating an account or using OSHA Scan (the "Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. OSHA Scan is a trade name ("doing business as") of GetAgenticApps LLC; GetAgenticApps LLC is the contracting party for all purchases made through the Service.

OSHA Scan uses AI computer vision to analyze job-site photos and video walkthroughs and flag potential OSHA-relevant hazards. The output is a preliminary safety aid, not a professional safety inspection, a legal compliance certification, or an official finding under any OSHA regulation. The AI can miss hazards, mis-categorize conditions, or produce incorrect confidence scores. You remain solely responsible for actual workplace safety, OSHA compliance, and any corrective action. OSHA Scan is not affiliated with, endorsed by, or connected to the U.S. Occupational Safety and Health Administration.

Free tier. New accounts receive 5 complimentary scans. No credit card is required to start. Free scans do not roll over and cannot be transferred.

Paid plans. Paid subscription plans (when available) are billed monthly or annually as chosen at checkout. Prices are listed in USD on the Pricing page. You authorize us to charge your payment method on a recurring basis until you cancel. See our Refund & Cancellation Policy for details on cancellations and refunds.

Usage limits. Each plan includes a fixed number of AI scans per billing period. Unused scans do not roll over to the next period. We may offer add-on scan packs at our discretion.

Payment processing. Charges are billed by GetAgenticApps LLC, the company that operates OSHA Scan, and will appear on your card statement as "OSHA SCAN". All prices are in U.S. dollars (USD).

You may not use OSHA Scan to: (a) upload content that is illegal, harmful, or violates third-party rights; (b) attempt to reverse-engineer, scrape, or systematically extract the AI model's outputs; (c) resell or sublicense the Service without written permission; (d) impersonate another person or organization; or (e) interfere with the security or integrity of the Service. We reserve the right to suspend or terminate accounts that violate these rules.

The OSHA Scan platform, its AI models, branding, and underlying code are owned by GetAgenticApps LLC. Your inspection reports and uploaded photos remain yours. By uploading photos, you grant us a limited license to process them to generate your report and store them as part of your account. We do not use your photos to train AI models without your explicit consent.

How we collect and handle your data is described in our Privacy Policy. By using the Service you agree to that policy.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR HAZARD WILL BE DETECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETAGENTICAPPS LLC'S TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 IF YOU HAVE NOT MADE ANY PAYMENTS. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall first be addressed by contacting us. If not resolved informally within 30 days, disputes shall be submitted to binding arbitration in accordance with the JAMS Streamlined Arbitration Rules, with proceedings conducted in English. You waive any right to a jury trial or class action.

We may update these Terms from time to time. Material changes will be notified via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
